Heard Mr. Singh, learned Advocate for Applicant and Mr. Haldankar, learned APP for Respondent - State. 2.

This is an Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking Regular Bail in connection with C.R.No.199 of 2024 registered with Goregaon Police Station for the offences punishable under Sections 406, 409, 420, 463, 464 and 465 read with 34 of the Indian Penal Code, 1860. 3.

Mr. Singh would submit that present Application arises out of C.R.No.199 of 2024 and this Court had in the case of co-accused decided his Anticipatory Bail Application No.3609 of 2024 on 24.01.2025. Copy of the said order shall be placed before me. He would submit that charge-sheet against the Applicant had deposited

14.BA.684.25.doc pledged spurious gold ornament with the bank at the time of borrowing the loan amount.

He would submit that this Court has opined in the order dated 24.01.2025 that when the bank disbursed the loan to ascertain the purity of the gold in accordance with the law and normal practice adopted and after the hiatus of 2 years to allege that the said ornaments which were pledged are spurious is surprising. He would submit that the role of the Applicant is identical. There is a possibility of suspicion or doubt arising in the present facts and circumstances. 5.

Mr. Haldankar is directed to take appropriate instructions from the concerned Investigating Officer and apprise the same to this Court on the next adjourned date.
