Heard Mr. Sawalkar, learned Advocate for Applicant and Mr. Karmakar, learned APP for Respondent.

Applicants in the present case are incarcerated for a period of more than 8 years in an offence under Section 302 of the Indian Penal Code, 1860 (for short 'IPC'). Trial is commenced but prosecution has examined only 4 witnesses out of probable 32 witnesses which prosecution ae desirous of examining.

Learned APP shall take appropriate instructions from Investigating Officer and apprise the Court accordingly. It is clarified that considering long incarceration of Applicants, Applications shall be
