I have heard Mr. Shukla, learned Advocate for Applicant; Mr. Dedhia, learned APP for Respondent No.1 - State and Mr. Mukte, learned Advocate for Respondent No.2 / complainant at length. 2.

In the present crime, age of the Applicant is 45 years whereas the age of prosecutrix is between 9 to 12 years old which is borne out from the record.

One of the submission made by the learned Advocate for Applicant is that there is a motive ascribed to the filing of the present complaint which needs to be considered by the Court. That apart, considering the long incarceration of the Applicant for more than 4 and 1⁄2 years in custody being one of the primary ground for seeking

40.BA.698.25.doc bail. He would submit that the charge has not been framed till date and hence the right of the Applicant for a speedy trial is jeopardised. 4.

In view of the above, present Application will be heard on the next adjourned date which shall be noted by the parties. 5.

List the Bail Application on Board on 15th April, 2025. To be placed on the 'Supplementary Board'.
