This is an Application under Section 439 of the Code of Criminal Procedure, 1973 seeking Regular Bail in connection with C.R.No.273 of 2021 registered with Shivaji Nagar Police Station, Ambernath, Thane for the offences punishable under Sections 363, 364-A and 120-B of the Indian Penal Code, 1860. Applicant is incarcerated for 3 and 1⁄2 years. He is 25 years old. 3.

Mr. Rawat would persuade the Court to consider rejection of 2 previous Bail Applications. While passing the previous orders in previous Bail Applications directions were specifically given by the Court to file Bail Application, if there was no progress in the trial.

27.BA.704.25.doc Initially while disposing first Bail Application Court had given direction that if the trial is not commenced within 6 months, Applicant to renew his Bail Application. Similar direction was also given by Court while disposing second Bail Application. Both orders are appended to the present Application.

Ms. Newton is directed to take appropriate instructions from the concerned Investigating Officer and apprise the Court the status of trial on the next adjourned date.

Considering the submissions made by Mr. Rawat delineated herein above, I am inclined to take up this Application for hearing.
