The Application is for grant of bail.

One of the ground raised in the Application is delay in trial.

Learned Public Prosecutor invited my attention towards the observations of the learned Additional Sessions Judge, Akola in para 5, wherein it is observed that the prosecution has examined in all 4 witnesses. The case is part heard and the oral evidence discloses the involvement of the present Applicant. It is further observed that the witnesses were present before the Court but the defence Counsel has requested for adjournment on the reason that they want to attend the funeral of their relatives.

Learned Public Prosecutor is requested to call the status report, which is required for the disposal of the Application.

At the same time, learned Counsel for the Applicant is also requested to place on record the entire roznama.

Call the report from the Additional Sessions Judge, Court No. 2, Akola within one week.
