By the present application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, Applicant is seeking bail in connection with C. R. No.205 of 2019 registered with Chiplun Police Station, Ratnagiri for the offences punishable under Sections 363, 376(3) of the Indian Penal Code, 1860 and 4, 7, 8 and 12 of the Protection of Children from Sexual Offences Act, 2012. 3.

Ms. Veera Shinde, learned APP for the State points out to the order dated 04.01.2023 passed in Bail Application No.283 of 2021 and submits that the liberty granted in the said order, required to be availed before the learned Trial Court, at the first instance. 4.

In view of the above, Ms. Grishma Lad, learned Advocate for

37-ba-748-2025.doc the Applicant, on instructions from the Applicant, craves leave to withdraw the present bail application to approach the learned Trial Court with a fresh bail application in terms of the liberty granted by this Court in its order dated 04.01.2023, passed in Bail Application No.283 of 2021. Leave as prayed for is granted. 5.

If such application is filed before the learned Trial Court, the same be considered on its own merits and in accordance with law. 6.

Bail Application No.748 of 2025 is dismissed as withdrawn with the liberty as above.
