This is an application for regular bail.

The applicant came to be arrested in Crime No.26 of 2014 registered at Shivajinagar Police Station, Ichalkaranji, Dist.-Kolhapur. for the offences punishable under Sections 302, 341, 120 (b) read with Section 34 of the Indian Penal Code and Section 135 of the Maharashtra Police Act. 3.

There was a financial dispute between the deceased and co-accused Vishwanath Itgi. It is alleged that thus on the date of incident, which took place on 24.02.2024 the said co-

accused in connivance with the present applicant and other co-accused committed the murder of the deceased. 4.

I have the learned counsel for the applicant and learned A.P.P. for the Respondent-State.

The bail is sought on the ground of long incarceration. The learned counsel for the applicant submits that the applicant is in jail for more than 10 years. It is submitted that after 25.07.2024, there is no progress in the trial.

On the other hand, the learned A.P.P. for the Respondent-State submits that considering the nature of crime the applicant may not be released on bail and trial be expedited.

The applicant is in jail for more than ten years. There are no other criminal antecedents against the applicant. I am therefore, inclined to release the applicant on bail.

ORDER

(i) Criminal Bail Application is allowed;

(ii) The applicant is directed to be released on bail in connection with Crime No.26 of 2014 registered at

Shivajinagar Police Station, Ichalkaranji, Dist.-Kolhapur. for the offences punishable under Sections 302, 341, 120 (b) read with Section 34 of the Indian Penal Code and Section 135 of the Maharashtra Police Act on executing P.R. Bond in the sum of Rs.15,000/- with one surety; (iii) Application stands disposed of accordingly.
