Heard Mr. Munde, learned Advocate for Applicant and Ms. Newton, learned APP for Respondent.

Applicant is incarcerated and arraigned as Accused No.3 for more than 6 years for offences punishable under Sections 302, 363, 364, 365, 394, 201, 120B and 34 of the Indian Penal Code, 1860 (for short 'IPC') wherein there are seven Accused persons. Role of Applicant is to have conspired alongwith Accused No.1 in taking victim from Ghatkopar in a car and thereafter the case of prosecution is based on circumstantial evidence since the body of victim was found after few days in decomposed state in Panvel area.

Mr. Munde would submit that considering the long incarceration and charge having been framed and prosecution stating
15.BA.758.2025.doc that they would be examining 187 witnesses in the crime, there is no certainty that trial will commence and be completed in the near foreseeable future. He would submit that 5 out of 7 Accused persons are already enlarged on bail on ground of long incarceration itself. Mr. Munde would inform the Court that those orders are all annexed to the Application.

Prosecution shall take appropriate instructions and apprise the Court as I am inclined to take up this matter for hearing in view of submissions made by Mr. Munde.
