Heard Mr. Kuldeep Nikam learned Advocate for the Applicant. Ms. A. A. Takalkar, learned APP for the State and Ms. Kanchan Pawar, learned Advocate for the Respondent No.2. 2.

By the present application, Applicant is seeking bail in connection with C.R. No.453 of 2017 registered with the Pimpri Police Station, Dist. Pune.

Mr. Kuldeep Nikam, learned Advocate for the Applicant submits, that the said crime is now registered as Special Case No.261 of 2018 and same is pending before the Additional Sessions Judge, Pune.

Ms. Kanchan Pawar, learned Advocate for the Respondent

33-ba-782-2025.doc No.2 points out to the order dated 03.10.2024, passed by this Court in Bail Application No.3292 of 2023. Referring to the liberty granted by this Court to the Applicant, she submits that the Applicant is required to avail of the said liberty before the learned Trial Court, at the first instance.

Mr. Kuldeep Nikam, learned Advocate for the Applicant, on instructions from the Applicant, craves leave to withdraw the bail application for filing a fresh bail application before the Trial Court, in terms of the liberty granted by this Court in the order dated 03.10.2024, passed in Bail Application No.3292 of 2023. He states that application will be filed within ten days from today. Leave granted with liberty.

In the even, such application is filed, the same shall be decided on its own merits and in accordance with law. Learned Trial Court is requested to make an endeavor to dispose off such application if filed, as expeditiously as possible. 7.

The Bail Application No.782 of 2025 is dismissed as withdrawn with the liberty as above.
