This is an application for regular bail.

The applicant came to be arrested in Crime No. 243 of 2016 registered at Deccan Police Station, District : Pune, for the offences punishable under Sections 409, 420 r/w Section 34 of Indian Penal Code and Section 3 of the The Maharashtra Protection of Interest of Depositors (MPID) Act, 1999. 3.

The allegations of defrauding the investors are against the Directors of Samruddhi Jeevan Multi-State Multi Digitally signed by SAJAKALI LIYAKAT JAMADAR Date:

2025.04.30 14:34:00 +0530 SAJAKALI LIYAKAT JAMADAR Purpose Co-operative Society Ltd. Admittedly, the applicant

was not the Director of the said Co-operative Society. According to the prosecution, certain amount was transferred by the directors of the said Co-operative Society to Prosperity Agro India Ltd. The present Applicant was a director of said Prosperity Agro India Ltd.

I have heard the learned counsel for the applicant and the learned counsel for the Respondent-State. 5.

The learned counsel for the applicant submits that the applicant was the Director of the said Prosperity Agro India Ltd. for three months only. It is submitted that the applicant has nothing to do with the alleged crime. It is further submitted that the applicant is in jail for about nine months and there are no other criminal antecedents against her. 6.

On the other hand, the learned A.P.P. for the Respondent-State submits that there are thousands of investors. It is submitted that the amount of Rs.3,52,00,000/- was transferred to the Prosperity Agro India Ltd. It is submitted that considering the nature of offence, the applicant may not be released on bail.

The fact that the applicant was director of Prosperity Agro India Ltd. for the period of three months is not disputed. The applicant is in jail for nine months. Considering the overall facts and circumstances, I am inclined to release the applicant on bail on certain conditions.

ORDER

(i) Criminal Bail Application is allowed;

(ii) The applicant is directed to be released on bail in connection with Crime No. 243 of 2016 registered at Deccan Police Station, District : Pune, for the offences punishable under Sections 409, 420 r/w Section 34 of Indian Penal Code and Section 3 of the The Maharashtra Protection of Interest of Depositors (MPID) Act, 1999 on executing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount;

(iii) The applicant shall deposit her passport with the Deccan Police Station, Pune.

(iv) Application stands disposed of accordingly.
