By the present Application filed under section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short "BNSS"), the Applicant is seeking regular bail in Crime No. I-198 of 2021 registered at Mumbai Naka Police Station for the offences punishable under Section 302, 120-B, 279, 337, 338 and 304-A of the Indian Penal Code and under Sections 184 and 134/187 of the Motor Vehicle Act.

Mrs. Anamika Malhotra, learned APP for State points out to the order dated 19th June, 2024 passed by this Court in Criminal Talwalkar

907.BA798.2025.odt Bail Application No. 3311 of 2023 and other two connected matters, to submit that the liberty granted by this Court is required to be availed before the Trial Court, at the first instance. 4.

In view of the above, Ms. Savvy Kolhekar, learned Advocate for the Applicant on instructions from the Applicant crave leaves to withdraw the present Bail Application by seeking liberty to file a fresh bail application in terms of the liberty granted to the Applicant by order dated 19th June, 2024 in Criminal Bail Application No. 3311 of 2023 and other two connected matters. Liberty as prayed for is granted. In the event, such application is filed before the Trial Court, the same shall be considered on its own merits and in accordance with law.

In view of the above, Bail Application No. 798 of 2025 is dismissed as withdrawn with the liberty as above. (ASHWIN D. BHOBE, J.) Talwalkar
