Heard Mr. Bhujbal, learned Advocate for Applicant and Mr. Karmakar, learned APP for State.

Applicant is indicted for the offences punishable under the provisions of NDPS Act for being in possession of intermediate quantity of the alleged contraband i.e. Ganja quantified as 3.340 Kgs. (approx.) which is less than the commercial quantity (20 Kgs). Applicant is a ikuokyk having his business. He is apprehended on 14.11.2024. He is the sole accused. Considering confiscation and seizure of intermediate quantity, rigors of Section 37 of the NDPS Act would not apply. Nevertheless prosecution will be heard. 3.

Learned APP shall take appropriate instructions on the aforesaid submissions and apprise the Court on the next adjourned date.
