Heard Ms. Sharma, learned Advocate for Applicant and Ms. Bajoria, learned APP for Respondent.

Applicant is a first time offender having been apprehended with intermediate quantity of alleged contraband namely 12.42 grams of Mephedrone. Rigours of Section 37 of the Narcotics and Psychotropic Substances Act, 1985 (for short 'NDPS Act') would therefore not apply.

Ms. Sharma would submit that Applicant is 28 years of age who runs a Chinese food stall and considering his incarceration of 4 months and recovery of intermediate quantity this Court be pleased to consider his Application for bail.

Ms. Bajoria would submit that she be allowed to take
