Heard Mr. Kashid, learned Advocate for Applicant and Ms. Newton, learned APP for Respondent.

Applicant is incarcerated for a period of 10 months for offences punishable under Sections 302, 307, 324, 504, 506, 143, 147, 148, 149 of the Indian Penal Code, 1860.

Mr. Kashid would submit that Applicant is suffering from enlargement of prostrate gland problem while in custody. He would submit that considering role of Applicant as not been the principal assailant, the Court consider his case in view of his medical condition. 4.

Ms. Newton, learned APP is directed to call for a report from Chief Medical Officer of the Prison Hospital of Adharwadi Prison, Kalyan as to medical status of Applicant so that this Court can be
