Heard Mr. Nevgie, learned Advocate for Applicant and Mr. Karmakar, learned APP for Respondent No.1.

Applicant is indicted under provisions of Indian Penal Code, 1860 and Protection of Children from Sexual Offences Act, 2012 (for short 'POCSO'). He is incarcerated for 43 months. 3.

Mr. Karmakar, learned APP appears for Respondent No.1. He waives service for Respondent No.1.

Issue notice to private Respondent No.2. Humdast permitted. In addition to Court's notice, Applicant is directed to serve a copy of this order and copy of the Application on the Investigating Officer directly. Mr. Nevgie informs the Court that Respondent No.2 is already
