Heard Mr. Arote, learned Advocate for Applicant and Mr. Dedhia, learned APP for Respondent.

Mr. Arote would inform the Court that Applicant is a lady who is incarcerated for past one and half year in offences punishable under provisions of the Indian Penal Code, 1860, Maharashtra Police Act, 1951 and Maharashtra Control of Organised Crimes Act, 1999 (for short 'MCOC Act').

Charge against Applicant is that she is the sister of main accused - gang leader. However, Mr. Arote would draw my attention to the reasoned order dated 10.02.2025 in Bail Application No.5121 of 2024 passed by this Court (Coram : Manish Pitale, J.) enlarging accused No.14 i.e. mother of Applicant on bail. He would submit that present Applicant and her mother are arraigned as accused Nos.15 and

8.BA.850.2025.doc 14 in the same crime and they both were arrested together when they were going to meet their Advocate one and half year ago. 4.

In so far charge against Applicant is concerned, Mr. Arote would inform the Court that Applicant is indicted for harbouring the main accused - gang leader and some members of his gang. He would rely upon the aforesaid order passed by this Court to submit that role of Applicant is rather much lesser than the role of accused No.14 and therefore persuade the Court to consider the case of Applicant, she being a lady. Prosecution shall take appropriate instructions and apprise the Court on the next adjourned date. 5.

Considering this is case for offences punishable under provisions of MCOC Act, Respondent is directed to file its Affidavit-inReply within a period of three weeks from today. 6.

Stand over to 20th March, 2025.
