This is an application for regular bail.

The applicant came to be arrested in Crime No. 393 of 2024 registered at Shivaji Nagar Police Station, Ichalkaranji District : Kolhapur, for the offences punishable under Sections 302, 143, 147, 148, 149, 427 and 109 of the Indian Penal Code.

According to the prosecution, on the date of incident which took place on 12.05.2024, the present applicant and Digitally signed by SAJAKALI LIYAKAT JAMADAR Date:
2025.03.24 19:35:01 +0530 other co-accused assaulted the deceased by sharp weapons SAJAKALI LIYAKAT JAMADAR
and committed his murder.

I have heard the learned counsel for the applicant and learned A.P.P. for the Respondent-State.

The learned counsel for the applicant submitted that the applicant has nothing to do with the alleged crime. It is submitted that alleged eye-witnesses have not attributed any overt act to the applicant. It is submitted that there are no other criminal antecedents against the present applicant. 6.
On the other hand, the learned A.P.P. for the Respondent-State submits that involvement of the applicant in the crime in question is apparent from the statement of witnesses. It is submitted that considering the nature of offence, the applicant may not be released on bail. 7.
I have perused the statements of the eye witnesses recorded under Sections 161 and 164 of Cr.P.C. They have not attributed any specific overt act to the present applicant. In that view of the matter and as there are no other criminal antecedents against the applicant, I am inclined to release the applicant on bail.
ORDER
(i) Criminal Bail Application is allowed;
(ii) The applicant is directed to be released on bail in connection with Crime No. 393 of 2024 registered at Shivaji Nagar Police Station, Ichalkaranji District : Kolhapur, for the offences punishable under Sections 302, 143, 147, 148, 149, 427 and 109 of the Indian Penal Code, on executing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount; (iii) The applicant shall attend the concerned Police Station once in a month i.e. on first Saturday between 11:00 a.m. to 1:00 p.m. till conclusion of trial; (iv) Application stands disposed of accordingly.
