Heard Mr. Mahesh Vishwakarma, learned Advocate for the Applicant. Though, Mr. Mahesh Vishwakarma initially made submissions on the merits of the bail application, however during the midst of the arguments, he on instructions from the Applicant submits that the Applicant shall restrict and limit the ground of bail, on the Applicant being illegally detained for more than 24 hours without being produced before the Competent Magistrate. He points out to the paragraphs Nos. 4, and 5 of the memo of bail application, wherein the Applicant has made reference to the timings of he being taken in custody and the contentions pertaining to his illegal detention. He submits that by inadvertence the complainant/informant remained to be added as a party
15-ba-864-2025.doc Respondent No.2 to the present proceedings and therefore seeks leave to amend to add the complaint/ victim as Respondent No.2. 2.
Mr. A. A. Palkar, APP for the State submits that the presence of the Complainant/ Victim in the bail application is necessary. 3.
In view of the above, leave granted to the Applicant to add the Complaint/ Victim as party Respondent No.2. Amendment be carried out forthwith. Upon the amendment being carried out, issue notice to the Respondent No.2, returnable on 26th August, 2025.

Notice on Respondent No.2 be served through Investigation Officer Pali Police Station, Raigad with a direction to file service report on or before the next date of hearing. 5.
Mr. A. A. Palkar, learned APP for the State craves leave to file reply in the context of the grounds of illegal detention as raised by the Applicant. He seeks time till 25.08.2025 to file reply. Reply be filed on 25.08.2025 with an advance copy to the Advocate for the Applicant.

Mr. Mahesh Vishwakarma, states that the Respondent No.2 will be served by 26.08.2025.
