The Applicants came to be arrested on 17.07.2025, in connection with Crime No. 560/2025 registered with Police Station Arni, District Yavatmal for the offence punishable under Sections 7, 7A, 12 of the Prevention of Corruption Act, 1988.

The crime is registered on the basis of the report lodged on an allegation that the present Applicant No.1 has demanded the bribe of Rs.20,000/- and after negotiation shown the acceptance of Rs.10,000/- to clear the bills of the contractor, and therefore, the trap was laid and during that trap the Applicant No.2 was found accepting the amount for the Applicant No.1. On the basis of the said report Police have registered the crime against the present Applicants. 3.
Learned Counsel for the Applicants submitted that, primary investigation is already completed. As far as further incarceration of the present Applicants is concerned,
2 935.BA.866-2025.odt which is not required. The tainted notes are also recovered. In view of that, they be released on bail.

Learned APP, strongly opposed the said Application and submitted that the involvement of the present Applicants in a serious offence like corruption when they were working as a public servant. In view of that, the Application deserves to be rejected.

On hearing both the sides and on perusal of the recitals of the FIR and investigation papers, as the investigation is practically completed, further incarceration of the present Applicants, is not required. In view of that, the Application deserves to be allowed. Accordingly, I proceed to pass the following order.
O R D E R
i.
The Application is allowed.
ii.
The Applicant No.1- Santosh Bhagawanrao Kshirsagar and Applicant No.2-Sagar Shankarrao Bharti in connection with Crime No.560/2025 registered with Police Station Arni, District Yavatmal for the offence punishable under Sections 7, 7-A, 12 of the Prevention of Corruption Act, 1988, be released on bail, on executing P.R. Bond in the sum of Rs.25,000/- (Rs. Twenty Five Thousand) each with one solvent surety in the like amount.

The Applicants shall not induce, threat or promise any witnesses who are acquainted with the facts of the case either personally or by way of electronic media.
iv.
The Applicants shall attend the concerned Police Station as and when required for the investigation purpose and shall cooperate with the Investigating Agency on issuance of the notice of 7 days in advance.

Pending application/s, if any, shall stand disposed of accordingly.
