Heard Mr. Kate, learned Advocate for Applicant and Mr. Kulkarni, learned APP for Respondent.

Applicant is indicted for offence punishable under Section 302 of the Indian Penal Code, 1860 (for short 'IPC') for having committed an attack and assault on deceased - victim who was his friend. He would submit that there is no motive escribed to incident in question as both Applicant and deceased victim were friends and having a drinking session.

3.

He would submit that verbal altercation in the said session escalated to fight which resulted in Applicant giving kick and fist blows to the victim who succumbed to his injury after 10 days in hospital. He would submit that there was no weapon used save and except use of kick and fist blow by Applicant.

The aforesaid submission of Applicant shall be examined by learned APP in the matter and accordingly role of Applicant shall be apprised to the Court.

At request of Mr. Kate, stand over to 30th April, 2025. To be placed on the 'Supplementary Board'.
