Heard Mr. Chavan, learned Advocate for Applicant and Ms. Ganapathy, learned APP for Respondent.

Pursuant to order dated 18.03.2025, the Chief Medical Officer of Arthur Road Central Prison, Mumbai has been placed before the Court. Perusal of that report, prima facie shows that Applicant has been advised continuous medication as per cardiologist's prescription. In view of the continuous treatment received by Applicant in the hospital during his incarceration in jail, it is prima facie seen that Applicant is suffering from Ischemic Heard Disease which is clearly diagnosed in his case.

In view of the above health condition of the Applicant, present Application shall be taken up for hearing and disposal by the
Court on the next adjourned date which shall be noted by the prosecution.

Mr. Chavan would submit that Applicant is arraigned as accused person wherein there are 6 Accused persons. 4 out of 6 accused persons have been enlarged on bail. Applicant is indicted under Sections 420 and 467 of the Indian Penal Code, 1860. According to Mr. Chavan in so far as the role of present Applicant is concerned, he would inform the Court that his bank account was used for the purpose of receiving the amount and transferring the same to the bank account of other co-accused persons.

He would persuade the Court to consider one fact namely that Applicant is not beneficiary of any of the amounts which is involved in the present case. He would submit that out of Rs.80 Lakhs transferred which is the subject matter of the present case, amount of Rs.50 Lakhs has already been seized and secured whereas in so far the balance Rs.30 Lakhs is concerned, he is not the beneficiary of the same.

Complainant is present in Court. He would persuade the Court to list the matter on some other date to allow his Advocate to make appropriate submissions. He would inform that Bail Application of other co-accused who is incarcerated in prison in the present crime is listed on 01.04.2025. Learned APP appearing in the present matter
shall take instructions and ascertain the role of Applicant and inform the Court accordingly on the next date.

Hence, list the present Bail Application on 01st April, 2025. To be placed on the 'Supplementary Board'.
