Heard Mr. Desai, learned Advocate for Applicant and Mr. Dedhia, learned APP for Respondent.

Applicant is indicted under Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'NDPS Act') for being in possession of 40 grams of alleged contraband namely Mephedrone which is admittedly intermediate quantity but from the premises of Applicant, 460 grams of alleged contraband has been recovered and he has been labelled as manufacturer.

Mr. Desai informs the Court that Applicant is suffering from Tuberculosis and therefore Court be pleased to call for appropriate medical report. The details of sufferance of Applicant are appended at page No.286 of the Application.

Considering the medical exigency expressed by learned

13.BA.919.2025.doc Advocate, Chief Medical Officer of the prison Hospital of Thane Central Prison where Applicant has been lodged is directed to consider the report which is appended at page No.286 shall prepare a report and submit the same with respect to his medical condition so as to enable this Court to consider the present Bail Application. Learned Advocate appearing for Applicant is directed to hand over the report appended at page No.286 of the Application to the Jail Authorities Thane Central Prison directly within a period of one week from today. 5.

Let the report be submitted within a period of one week from today.
