The applicant is arrested in Crime No.118/2025 for the offence punishable under Sections 109, 125(a), 351(2) and 3(5) of the Bhartiya Nyaya Sanhita.

The applicant and the First Informant are the friends. They went to take tea in the canteen. After sometime, the applicant asked the complainant to call his friends as he has some work with them and when complainant called his friends, on some old altercation applicant started verbal accusations and suddenly took out knife and assaulted Sahil on left side of his stomach, other two accused also came there and asked the complainant and his friends not to intervene. The injured was taken to Government Hospital and from there to private hospital. On the complaint lodged by the complainant, the crime is registered against the applicant. 3.
The learned Advocate for the applicant has stated that though three stabs are mentioned by the eye witnesses there is only one stab wound as per the medical report. The applicant is college going student. His intention was not to commit murder of the injured. Now the injured is discharged.

The learned Advocate for the applicant has relied on the judgment of this Court in case of Avinash Ajay Benewal V/s. State of Maharashtra reported in 2015 SCC OnLine Bom 191 wherein this Court has granted bail considering the age and the disadvantage of keeping a young boy in jail for a long period. The applicant has also relied on the order in case of Criminal Application (BA) No.637/2025 wherein for committing the offence the knife was used and the Court has granted bail. The applicant has stated that he is ready to abide all the terms and conditions imposed by this Court. Hence, prayed to release the applicant on bail.

Learned A.P.P. opposed the application stating that assault was very serious as pancreas came out. The injured was in hospital for 7 days. He has undergone surgery. Two accused persons were there. Considering the role, he was released. The learned A.P.P. has prayed to reject the application.

Heard both sides and perused the record.

The applicant asked the complainant to call his friends and thereafter assaulted with knife. The injuries are grievous. Though the injuries are grievous now the injured is discharged. The applicant is in jail since last 7 months.

Considering the observations made by this Court in case of Avinash Ajay Benewal (supra), age of the applicant 19 years and as he is a college going boy, case is made out to release the applicant on bail.

Accordingly, I pass the following order:
i) Applicant- Aman Ramesh Chavan be released on bail in Crime No.118/2025 for the offence punishable under Sections 109, 125(a), 351(2) and 3(5) of the Bhartiya Nyaya Sanhita, on his furnishing P.R.
3 ba924.2025.odt Bond in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand only) with one solvent surety in the like amount.
ii) The applicant shall not in any way tamper with the prosecution evidence.
iii) The applicant shall not pressurize or threaten the prosecution witnesses.
iv) The applicant shall co-operate with the Investigation Officer. v) The applicant shall not enter entire Buldhana district during the period of trial, except for attending trial.
