The learned counsel appearing for the applicant has relied on the orders of this court passed in criminal application No. 689/2025 and criminal application No. 498/2024, where those applications are allowed on the ground of delay in trial. The learned counsel appearing for the applicant submits that the present applicant also deserves for parity.

On the other hand, the learned APP submits that the trial has commenced and already four witnesses are examined. The prosecution is going to examine three witnesses tomorrow and further submits that only four to five witnesses are remained to be examined which would be completed within a month. She further submits that the trial is going on day to day basis. She submits that in the
2 10 BA 932.25 last week two witnesses are examined and today two witnesses are examined.

As the learned APP makes a statement that the trial would be concluded as early as possible preferably within three months. In this background, the learned counsel for the applicant seeks withdrawal of the application, with liberty to file a fresh bail application before this Court, if the trial is not concluded within three months.

The application is disposed of as withdrawn with liberty as prayed for.
