Considering incarceration of Applicant for past five years in the offences punishable under provisions of the Indian Penal Code, 1860 (for short 'IPC') and the Protection of Children from Sexual Offences Act, 2012 (for short 'POCSO Act'), the present Application shall be heard and decided on the next adjourned date. 4.

When matter is called out, none appears for Applicant. Advocate for Applicant is directed to remain present.

Mr. Raut, appointed Advocate appears for Respondent No.2. He would submit that age of prosecutrix was 15 years whereas age of Applicant was 20 years at the time of incident in question. 6.

Mr. Raut has made a submissions across the bar by placing on record Roznama in the case before Trial Court. He would submit that Applicant is delaying framing of chare before Trial Court and is constantly asking for time which is evident from Roznama placed on record.

In that view of the matter, it is the Applicant who is protracting the trial before Trial Court. Learned Advocate for Applicant shall apprise the Court on the next adjourned date on the aforesaid statement.
