By this Application, the Applicant is seeking regular bail in Crime No.1266 of 2023 registered with Kondhwa Police Station, Pune for the offences punishable under Sections 420, 406, 467, 468, 471 read with Section 34 of the Indian Penal Code, 1860 ('IPC' for short), and Sections 3 and 4 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act ('MPID Act' for short), 2.

It is prosecution's case that during period from 5th March 2020 to 10th March 2020, the Applicant and co-accused lured First Informant and

other Investors to invest money in their company with assurance of handsome returns but after investing amounts, the First Informant and Investors neither got their amount nor returns on it. 3.

It is contention of learned counsel for the Applicant that the Applicant is behind bars for more than one year and nine months. The allegations against the Applicant are that he has received amount of Rs.10 lakhs from the co-accused in his bank account. There are no allegations against the Applicant that he lured the investors to invest money in the First Informant's company. To show bona fide the Applicant has deposited Rs.10 lakhs. There is no progress in trial, and requested to allow the Application. 4.

It is contention of learned APP that the Applicant is involved in crime. The total amount involved in the crime is Rs.1,53,00,000/-. Out of this amount, Rs.10 lakhs is transferred in bank account of the Applicant by the co-accused, it shows involvement of the Applicant in crime. If Applicant released on bail, he may abscond or threaten First Informant and prosecution witnesses, and requested to reject the Application. 5.

I have heard both learned counsel. Perused charge-sheet and documents produced on record.

The allegations against the Applicant are that he received Rs.10 lakhs in his bank account from the co-accused. The Applicant has deposited

said amount to show his bona fide. The Applicant is behind bars for more than one year and nine months. There is no progress in trial. To show involvement of the Applicant in the crime, evidence is required. There are no allegations against the Applicant indicating that he induced the First Informant and other investors to invest money in the company. 7.

Considering these facts, I pass following order.

ORDER

(i) The Applicant-Majid Usman Attar be released on bail in Crime No.1266 of 2023 registered with Kondhwa Police Station, Pune, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.

(ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.

(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order.

(iv) The Applicant shall attend the concerned Police Station as and when required.
