Heard Ms. Trupti Shetty, learned Advocate for the Applicant, Ms. Megha Bajoria, learned APP for State and Mr. Firoz Benlim, learned Advocate for Respondent No. 2.

On 7th May, 2025 this Court had directed the prosecution to file medical report of the Applicant. Today, learned APP has tendered copy of the letter dated 03.06.2025 addressed to Registrar of this Court alongwith Prisoner's Medical Report dated 2.6.2025. Ms. Bajoria, learned APP states that the prescribed injection Adalimumab 40 mg. Is not available with the State. She states that the Respondent do not have objection if the said injection is procured by the family of the Applicant and handed over to the jail authority who will administer the same to the Applicant.

Ms. Trupti Shetty, learned Advocate for Applicant states that she need time to take instruction from the family of the Applicant on the said aspect. She request for time till 10th June, 2025. 5.

Ms. Bajoria, learned APP states that as time is being sought by the Applicant, in the eventuality of any untoward incident for want of administration of injection to the Applicant, the State should not be held responsible or liable. Ms. Trupti Shetty, learned Advocate for the Applicant states that as time is sought by her, in the event of such eventuality, the Applicant or family of the Applicant shall not hold the Respondent-State responsible.
