The learned counsel appearing for the applicant submits that he had preferred bail application before the Special Judge (MCOC Act), Nagpur, which was rejected on 21/10/2024. The said application was made only on the ground that accused No.6 was granted bail on 19/09/2024 by this Court, and on the ground of parity, he had applied for bail. The learned counsel further submits that he is now pressing the ground of "delay in trial", however, the same plea was never taken before the trial Court, and therefore, seeks permission to withdraw the present application, with liberty to apply afresh on the ground of "delay in trial".

Permission granted. The Criminal Application is disposed of as withdrawn, with liberty as prayed for.

It is made clear that this Court has not expressed any opinion on the merits of the case, nor on the ground of parity or on the ground of "delay in trial."

In case, the applicant applies before the trial Court, the trial Court shall decide the same on its own merits.
