The applicant is arrested in Crime No.69/2025 for the offence punishable under Sections 103(1), 109, 126(2), 115(2), 351(3), 3(5) and 61(2) of the Bharatiya Nyaya Sanhita, Sections 4 and 25 of the Arms Act and Section 135 of the Maharashtra Police Act. 2.
It is alleged that the applicant has given the contract to kill the deceased. In property transaction between the deceased and father of this applicant, there was a dispute. One of the accused is juvenile. The allegations are made that the deceased was in hospital and after 10 days he succumbed to injury. The statement of the deceased could not be recorded. Only on the statement made by the first informant, the crime is registered and since February 2025 applicant is in jail. 3.
The learned Advocate for the applicant has stated that only one entry of withdrawing the amount from the bank on that day is the alleged proof against this applicant. There is no other material to connect the applicant with this offence. Hence, prayed to release the applicant on bail.

Learned A.P.P. opposed the application stating that statement of mother of juvenile directly connects the applicant to the offence.
Juvenile has informed his mother that they have taken contract of murder from the father of this applicant and committed the murder of deceased. The statement of one of the friend is also there. There is evidence against this applicant. Hence, prayed to reject the application.

The complainant has filed the application to assist the prosecution. He has stated that there are whats-app conference calls on the same day between the accused persons and this applicant. The applicant was connected with accused persons on that day. Therefore, involvement of this applicant is there in said offence. Hence, prayed to reject the application.

Heard both sides and perused the record.

The applicant was not on the spot. The allegations are made that father of this applicant has given contract of killing of deceased. Only evidence against this applicant is that he has withdrawn Rs.10,000/- on that day.

Considering the allegations made against this applicant and the available evidence on record, the applicant deserves to be released on bail. Hence, the application is allowed.
i) Applicant - Saheel @ Sahil Bhowate S/o Ankush Bhowate be released on bail in Crime No.69/2025 for the offence punishable under Sections 103(1), 109, 126(2), 115(2), 351(3), 3(5) and 61(2) of the Bharatiya Nyaya Sanhita, Sections 4 and 25 of the Arms Act and Section 135 of the Maharashtra Police Act, on his furnishing P.R. Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with solvent surety in the like amount before the trial Court.
ii) The applicant shall not in any way tamper with the prosecution evidence.
iii) The applicant shall not pressurize or threaten the prosecution witnesses.
iv) The applicant shall co-operate with the learned trial Judge in the conduct of the trial.
