The applicant is arrested in Crime No.293/2025 for the offence punishable under Sections 108, 85 and 3(5) of the Bharatiya Nyaya Sanhita.

It is the case of prosecution that father of deceased has lodged complaint against the applicant that his daughter has committed suicide after 10 years of her marriage. The applicant is the husband of the deceased. She had committed suicide by jumping in well. The allegations are made that she was ill-treated for demand of Rs.2,00,000/- for digging well and the demand was fulfilled by the complainant. Thereafter also they continued to ill-treat her and therefore, she has committed suicide and offence is registered. 3.
The learned Advocate for the applicant submitted that the other family members of the applicant are already released on bail. The applicant is the husband. The charge sheet is filed. The investigation
is completed and further, investigation is not required. Hence, prayed to release the applicant on bail.

The learned A.P.P. opposed the application stating that as per postmortem report injuries were there on the person of the deceased. There is every possibility that she must have been assaulted by this applicant as allegations about ill-treatment by the applicant are there. One of the witness has stated that there used to be quarrels between the applicant and the deceased and because of said quarrels, she has committed suicide. Considering the nature of allegations, prayed to reject the application.

Heard both sides and perused the record.

Now the charge sheet is filed. Investigation is completed. The allegation about the demand of Rs.2,00,000/- is way back fulfilled. After 10 years of her marriage she has committed suicide. There is no nexus of allegation about demand and ill-treatment and death of deceased. As the charge sheet is already filed, further custody of this applicant is not required.
i) Applicant - Ramrao Tarachand Rathod be released on bail in Crime No.293/2025 for the offence punishable under Sections 108, 85 and 3(5) of the Bharatiya Nyaya Sanhita, on furnishing P.R. Bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) with solvent surety in the like amount before the trial Court. ii) The applicant shall not in any way tamper with the prosecution evidence.
iii) The applicant shall not pressurize or threaten the prosecution witnesses.
iv) The applicant shall co-operate the learned trial judge in the conduct of the trial.
