The applicant is arrested in Crime No.514/2024 for the offence punishable under Sections 310(1), 309(4), 324(4), 324(5), 351(1), 351(2) and 3(5) of the Bharatiya Nyaya Sanhita and Sections 4 and 5 of the Arms Act.

It is alleged that along with co-accused the applicant entered into bar and restaurant owned by the Informant and some of the accused have assaulted the Informant by means of knife and snatched an amount of Rs.1,000/- and also caused loss to the articles of the bar to the tune of Rs.15,276/-.

The learned Advocate for the applicant has stated that other co-accused are released on bail by this Court hence the ground of parity is available. Investigation is complete. The injury report shows that it is a simple injury. Hence, prayed to allow the application. 4.

The learned A.P.P. opposed the application stating that applicant is having criminal antecedents. Five crimes are registered against this applicant. Considering the criminal antecedents, the ground of parity is not available to this applicant. Hence, prayed to reject the application.

Heard both sides and perused the record.

The allegations made against this applicant are that along with co-accused, he entered bar and demanded ransom. He has taken amount. CCTV Footage shows that he along with co-accused the applicant was on spot who are already released on bail by this Court. Considering the role played by this Court, the parity is available. Hence, the application is allowed.

i) Applicant - Swapnil S/o Gajanan Telmasre be released on bail in Crime No.514/2024 for the offence punishable under Sections 310(1), 309(4), 324(4), 324(5), 351(1), 351(2) and 3(5) of the Bharatiya Nyaya Sanhita and Sections 4 and 5 of the Arms Act, on his furnishing P.R. Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with one solvent surety in the like amount. ii) The applicant shall not in any way tamper with the prosecution evidence.

iii) The applicant shall not pressurize or threaten the prosecution witnesses.

iv) The applicant shall co-operate with the Investigating Officer. (MRS.VRUSHALI V.JOSHI, J.)
