Heard learned counsel for the Applicant and learned APP for the State.

By this Application, the Applicant is seeking regular bail in Crime No. 1576 of 2021 registered with Chakan Police Station, District Pune for the offences punishable under Sections 302, 120B, 201 r/w 34 of the Indian Penal Code, 1860 (for short 'IPC') and Section 3(25) of Arms Act and under Sections 3,7 of Criminal Law Amendment Act. 3.

It is prosecution's case that on 23/12/2021, Applicant and coaccused murdered the deceased by firing on him. It is alleged that the incident was captured in the CCTV footage.

It is contention of learned counsel for the Applicant that the co-

accused - - Firoz @ Samer Kacharu Sayyed, against whom same allegations are leveled like the Applicant, has been released on bail by this Court [Coram: Anil S. Kilor, J.] by order dated 17/10/2024. Hence, Applicant is entitled for bail on principle of parity and requested to allow the application.

It is contention of learned APP that parity will not be applicable as role attributed to the Applicant and co-accused released on bail, are on different footing. Applicant has three antecedents. If Applicant is released on bail, he may abscond or threaten the prosecution witnesses and requested to reject the application.

I have heard both learned counsel and perused the chargesheet, documents produced on record.

It appears from record that role attributed to the Applicant and the co-accused- Firoz Sayyed are similar. Considering this fact, applicant is entitled for bail on principle of parity.

Hence, I pass the following order (i) The Applicant- Laxman Baburao Dhotre be released on bail in Crime No. 1576 of 2021 registered with Chakan Police Station, District Pune, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.

(ii) The Applicant shall not tamper with the evidence and/or

influence the prosecution witnesses.

(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order. (iv) The Applicant shall attend the concerned police station as and when called and cooperate with the investigating officer. (v) Bail Application is allowed in the aforesaid terms.
