This is an application for regular bail.

The applicant came to be arrested in Crime No. 382 of 2024 registered at Ichalkaranji Police Station, District : Kolhapur, for the offences punishable under Sections 420, 407, 409, 465, 467, 468, 471 r/w Section 34 of the Indian Penal Code.

The applicant is accused No.2 in the aforesaid crime. According to the prosecution, the applicant had obtained Digitally signed by SAJAKALI LIYAKAT JAMADAR Date:

2025.05.08 19:13:16 +0530 SAJAKALI LIYAKAT JAMADAR certain false stock receipts from accused No.1, who was

working at the warehouse of APMC, Ichalkaranji and on that basis obtained the loan of Rs.24,90,000/- from Sangli Urban Co-operative Bank, Islampur.

I have heard the learned counsel for the applicant and learned A.P.P. for the Respondent-State.

The learned counsel for the applicant on instructions submits that, the applicant, without prejudice to his rights, is willing to deposit the entire loan amount of Rs.24,99,000/- with the Sangli Urban Co-operative Bank, Islampur. It is submitted that the applicant is in jail for about eight months and the trial is not likely to be concluded in near future. 6.

On the other hand, the learned A.P.P. for the Respondent-State submits that the loan was availed by submitting false documents. It is submitted that considering the nature of offence, the applicant may not be released on bail.

The applicant is in jail for eight months. There are no other criminal antecedents. Considering the said facts and as the applicant is willing to deposit the entire loan amount of Rs.24,99,000/-, I am inclined to release him on bail.

ORDER

(i) Criminal Bail Application is allowed;

(ii) The applicant is directed to be released on bail in connection with Crime No. 382 of 2024 registered at Ichalkaranji Police Station, District : Kolhapur, for the offences punishable under Sections 420, 407, 409, 465, 467, 468, 471 r/w Section 34 of the Indian Penal Code on executing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount;

(iii) The applicant is permitted to deposit Rs.24,99,000/- with the Sangli Urban Co-operative Bank, Islampur.

(iv) The released warrant shall not be issued unless receipt in respect of deposit of the amount is produced on the record of the trial Court.

(v) Application stands disposed of accordingly.
