This is an application for regular bail.

The applicant came to be arrested in Crime No.964 of 2024 registered at Indapur Police Station, District : Pune Rural, for the offences punishable under Sections 109, 352, 351(2), 351(3) of the Bhartiya Nyaya Sanhita, 2023 (for short 'BNS').

The applicant and the complainant are relatives.
According to the prosecution, on the date of incident which took place on 13.11.2024 while the complainant and his minor son were going by motorcycle, at that time, the present applicant came from behind in Creta Car and tried to run the car over them with a view to kill them on account of previous dispute.

The learned counsel for the applicant and the learned counsel for the Respondent No.2 jointly submit that the parties have settled the matter amicably. The learned counsel for the Respondent No.2/complainant submits that the complainant has no objection if the applicant is released on bail and has tendered the affidavit of the complainant to that effect. The learned counsel for the Respondent No.2/complainant submits that the complainant is present in the Court. 6.
The learned A.P.P. submits that considering the nature of crime, the applicant may not be released on bail. 7.
It appears that the applicant is in jail for more than five months. There are no other criminal antecedents against the present applicant. Considering the overall facts and circumstances of the case, I am inclined to release the applicant on bail.
ORDER
(i) Criminal Bail Application is allowed;
(ii) The applicant is directed to be released on bail in connection with Crime No.964 of 2024 registered at Indapur Police Station, District : Pune Rural, for the
offences punishable under Sections 109, 352, 351(2), 351(3) of the Bhartiya Nyaya Sanhita, 2023 (for short 'BNS') on executing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount; (iii) The applicant shall pay the amount of Rs.50,000/- to the Central Police Welfare Fund in it's following bank account :

(iv) The release warrant shall not be issued unless the amount of Rs.50,000/- is deposited;
(v) Application stands disposed of accordingly.
