Learned counsel for the applicant submits that perusal of the chargesheet raises doubt as to whether alleged seized contraband was produced before the Magistrate or not. In this regard, reference is made to the panchnama indicating that twice signatures of panchas were obtained on the labels. By drawing attention of the Court to the photographs on record, it is argued that four signatures of panchas are not appearing on the labels. It is therefore contended that this is a case of false implication/tampering.

He further argues that the applicant has not been communicated the grounds of arrest, so also relative, friend is 24th March, 2026

27-BA-1101-2025 not communicated with the same. It is his contention that there is non-compliance of Sections 42, 50 and 52-A of the NDPS Act. He relies on judgment of Division Bench of this Court Considering compliance of judgment of Hanuman Choudhary Vs. The State of Maharashtra Thr. Ravet Police Station, passed in WP (St.) No. 17755 of 2024. 3.

Learned APP seeks time to respond to the applicant, for want of instructions from the investigating officer. 4.
