By this Application, the Applicant is seeking regular bail in C.R.No. 475 of 2024 registered with Ranjangaon MIDC Police Station, Pune for the offence punishable under Sections 74, 75(2) of Bharatiya Nyaya Sanhita, 2023 (for short "BNS Act") and under Sections 8 and 12 of Protection of Children from Sexual Offences Act, 2012 ( for short "POCSO Act").

It is prosecution's case that on 05.08.2024, the Applicant has outraged the modesty of the minor daughter of the first
informant.

It is contention of learned counsel for the Applicant that Applicant is behind bar for one year and four months. The Applicant has no antecedents. There is no progress in the trial and requested to allow the Application.

It is contention of learned APP along with learned counsel for the Respondent No.2 that the Applicant has outraged modesty of the victim, who was 14 years of age. It is submitted that the Applicant is a relative of the victim. If Applicant is released on bail, he may threaten the prosecution witnesses and the victim. The charge has been framed. Hence, requested to reject the application. 5.
I have heard all learned counsel. Perused FIR and documents produced on record. Considering the allegations against the Applicant and the fact that the Applicant is behind bar for one year and four months, it may take time to conclude the trial. The Applicant has no antecedents. Considering these facts, I pass following order.
ORDER
i.
The Applicant is released on bail in C.R.No. 475 of
2024 registered with Ranjangaon MIDC Police Station, Pune, on executing P.R.Bond of Rs.30,000/-, on furnishing one or two sureties in the like amount. ii.
The Applicant shall attend the concerned Police Station as and when required.
iii.
The Applicant shall not tamper with evidence or attempt to influence the witnesses. The Applicant shall not contact the complainant, victim, witnesses or any other person concerned with present case.
iv.
The Trial Court shall not be influenced by the observations made in this order and shall decide the matter on its own merits and in accordance with law. 6.
The Bail Application is allowed in the aforesaid terms and is accordingly disposed of.

All concerned to act on the authenticated copy of this order.
