Mr. C.A. Lokhande, A.P.P. for the non-applicant/State. CORAM: MRS.VRUSHALI V. JOSHI, J.
DATED: 1.12.2025.
This application is filed on the ground of delay in trial. Since last 30 months the applicant is in jail. On perusal of the status report it appears that on 28.10.2025 and 3.10.2025 evidence programme was filed by the prosecution. Case is pending under the caption of evidence. Once the trial has commenced as per the observations in X V/s. State of Rajasthan reported in 2024 SCC OnLine SC 3539 the Court should be loath in granting bail. As the case is fixed for evidence, liberty is granted to the applicant to apply afresh if the trial is not completed within a period of 8 months. Accordingly, application is rejected and disposed of.
