By this application, the applicant seeks bail in Crime No.313 of 2016 registered with Shahupuri Police Station, District Kolhapur for the offences punishable under Sections 406, 420, 465, 468, 471 read with Section 34 of the Indian Penal Code (IPC). 2.

The prosecution case in short is that Complainant - Ranjit Vishni Savratkar lodged the First Information Report alleging that he was trying to get job in Indian Army. At that time he and his father got acquainted with the applicant. According to the complainant, the applicant had informed him about the availability of jobs in Army and he had asked the complainant's father to send the complaint along with him and accordingly his father had taken him to Gauhati, Assam. At that place, the present applicant met him and asked them to go at

Shilong. At that place the applicant had introduced the complainant with co-accused - Sagar Bhosale. Thereafter, applicant and co-accused Sagar Bhosale have introduced them with another co-accused Ajit Khandagale and Anish Shaikh. Thereafter, applicant and co-accused Sagar Bhosale had asked the complainant that after his medical examination, amount of Rs. 4,50,000/- is required. Thereafter, applicant came to Kolhapur. He talked with the complainant's father about the money. Thereafter, his relative Rajendra Shinde and brother Sangam had given cash amount of Rs.2,50,000/- to the applicant at his house. Thereafter, he came to know from his father that the applicant had informed him that unless the entire amount is paid, his work will not be done, therefore, on the say of applicant, the amount of Rs.90,000/- was deposited in the bank account of Bajirao S. Mohite and thereafter in the month of August-2015 an amount of Rs. 1,10,000/- was paid in cash to the applicant. 3.

It is further alleged by the complainant that applicant and co-accused by gaining trust of the complainant, his relatives and people known to the complainant demanded and accepted amount by saying that they will give them employment in the Army and taken total amount of Rs. 38,54,000/- from the complainant and witnesses. It is further alleged by the complainant that applicant and co-accused have not given employment to the complainant and witnesses in the

Army and also not returned the amount to the complainant and witnesses and cheated them.

Heard learned Advocate for the Applicant, learned APP for the Respondent-State instructed by the Investigating Officer, who is present in the Court. Perused the record.

The applicant seeks bail on the ground of parity as coaccused Sagar Bhosale is granted bail by the trial Court vide order dated 01.02.2017.

Learned APP strenuously opposed the application stating that the involvement of applicant is clear from the investigation papers and he has duped many persons and he was absconding for a period of eight years, therefore may not be granted bail. 7.

Learned Advocate for the applicant then submits that the applicant was suffering from "Major depressive disorder, in remission", which is certified by the Medical Department of Psychiatry, Rajarshi Chhatrapati Shahu Maharaaj Government Medical College, Kolhapur. According to him, the applicant is private contractor, who takes painting contract in which he was very much available in Kolhapur and was undergoing treatment. 8.

The applicant is arrested on 28.03.2024. Charge-sheet in the present crime is filed on 15.05.2024. Total 29 witnesses are cited in

the charge-sheet and though charge is framed on 30.07.2025, till date not a single witness is examined.

In the backdrop of the above, the applicant deserves to be released on bail on the ground of parity on certain conditions. 10.

The application is allowed.

The applicant - Sagar Mohite @ Bajirao S. Mohite be released on bail in connection with Crime No.313 of 2016 registered with Shahupuri Police Station, District Kolhapur, on furnishing Personal Bond in the sum of Rs.1,00,000/- with one or more surety in the like amount.

Till completion of trial, the applicant shall attend the concerned police station twice in a month, on first and last Sunday of every month.

13.

The applicant shall not tamper the prosecution evidence and shall scrupulously attend the trial regularly. (NITIN B. SURYAWANSHI, J.)
