The learned counsel appearing for the applicant submits that the applicant has not filed application before the trial Court raising the ground of delay in trial. He furhter submits that the right to a speedy trial is a fundamental right enshrined under Article 21 of the Constituion of India, as was observed by the Supreme Court in catena of judgments. Therefore, he submits that as he has not raised the said ground before the trial Court, he may be permitted to raise the same.

Therefore, he prayed to withdraw the present application with liberty to file application before trail Court raising the ground of "Delay in Trial".
