The learned counsel appearing for the applicant submits that the applicant is undergoing sentence in another case under Section 302 for life imprisonment. He further submits that while the applicant was on Furlough leave, he is alleged to have committed the present offence. Even if he was released in the present case, he would not be released as he is undergoing imprisonment in the another case.

In this view of the matter, the learned counsel submits that, in case, the applicant got bail, or acquitted, or is otherwise released from the jail in the future, he may be granted liberty to prefer a fresh application once again in the present case. Accordingly, the learned counsel seeks permission to

13-Cr.BA-1133-2025 withdraw the present application with liberty to file a fresh application.

Permission granted. The Criminal Application is disposed of as withdrawn, with liberty as prayed for.
