Heard Ms. Charania, learned Advocate for Applicant and Haldankar, APP for Respondent No.2.

Applicant is an educated offender who is an IIT Graduate a teacher and teaching students. He is apprehended with alleged contraband namely Zolpidem. The contraband in question is 50 grams which is admittedly intermediate quantity since commercial quantity is 250 grams under the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'NDPS Act'). In that view of the matter, rigors of Section 37 of the NDPS Act would not apply. He is incarcerated for the last 6 months.

Ms. Charania would inform the Court that apart from offences under the NDPS Act, charges under Sections 420 and 465 of
5.BA.1152.2025.doc the Indian Penal Code, 1860 (for short 'IPC') for being in possession of identity cards which he used for procuring contraband have also been foisted on Applicant. Admittedly, offences under Sections 420 and 465 of the IPC would be Magistrate triable offence. 4.
Learned Advocate for Applicant would submit that though Union of India has been impleaded as Respondent No.1, the principal contesting Respondent is the State of Maharashtra. She would submit that Application copy has been served on the Respondents. I am informed that Mr. Haldankar, learned APP appears in the matter on behalf of State of Maharashtra. He is directed to take appropriate instructions on the submissions made by the learned Advocate for Applicant which are delineated hereinabove. Considering that Applicant is a teacher by profession and in the facts of the present case this Application shall be determined on the next adjourned date which shall be noted by the prosecution.
