Heard Mr. Shah, learned Advocate for Applicant and Ms. Ganapathy, learned APP for Respondent.

Applicant is indicted for offence punishable under Section 302 of the Indian Penal Code, 1860. Mr. Shah in his usual fairness would inform the Court that in the year 2022, previous Bail Application was rejected by the Sessions Court on merits considering the gravity of crime.

He would inform the Court that Applicant has filed two previous Bail Applications which are rejected. He would persuade the Court to consider Application for bail, considering long incarceration of Applicant since 02.11.2018 for a period of 6 years 4 months and 22 days and would submit that charges have not been framed till date in the trial.

Ms. Ganapathy, learned APP appears for the prosecution. She is directed to take instructions on two counts namely status of the trial as informed by the learned Advocate for Applicant and precise role of Applicant in the crime.

Considering the long incarceration of Applicant pending trial, this Court shall take up this Application for hearing and disposal on the next adjourned date which shall be noted by the prosecution. Bail application No.5298 of 2024 of another co-accused in the same crime is kept on 04.04.2025.

List Bail Application No.5298 of 2024 of another co-accused alongwith present Application on 04th April, 2025 on the 'Supplementary Board'.
