Mr.Tiwari, learned counsel for the Applicant submits that all the witnesses have been examined but at the stage of recording statement of the accused under Section 313 of the Cr.PC, the prosecution has introduced two new witnesses whom they want to examine. He submits that Applicant was arrested on 21st March, 2025 and has suffered incarceration for 18 months. Hence, he has made this Application.

Mr.Dabke, learned APP on the other hand, on instructions, submits that the trial is likely to conclude within a foreseeable future.

In these circumstances, learned counsel for the Applicant seeks permission to withdraw the present Bail Application with liberty to file a fresh Bail Application after 6 months, if the trial does not progress substantially. 4.

Permission to withdraw the present Bail Application is granted with liberty as prayed. 5.
