Heard Mr. Mulekar, learned Advocate for Applicant, Mr. Dedhia, learned APP for State and Mr. Saxena, learned Advocate for First Informant.

The Applicant stands indicted for offenses punishable under Sections 406 and 420 read with Section 34 of the Indian Penal Code for the alleged siphoning of an amount of 1.75 Crores. ₹ 3.

Mr. Mulekar would submit that even according to the chargesheet which has been filed on record, the bank entries prima facie show that the amount of Rs. One Crore Eight Lakhs has been returned back to the first informant or his brother which is evident from the bank statements. He would submit that insofar as the balance amount is concerned, Applicant is helpless as on today. He has

7. BA-1184-25.docx no assets virtually to satisfy the same. He would submit that Applicant is incarcerated for the last 8 months. He would submit that Applicant has received a divorce notice from his wife. He would persuade the Court to consider the fact that Applicant is a highly educated person and was employed as Company Secretary in the Company wherein the alleged fraud had taken place. He would submit that apart from the Applicant, there are three more accused in the crime, namely the wife of Applicant and her parents, who have already been granted anticipatory bail by the Court.

Mr. Saxena is appearing for the First Informant. He would like to file Intervention Application to place on record the correct facts. If he desires to file the Intervention Application, the same can be filed by him in accordance with law.
