Heard Mr. Upadhyay, learned Advocate for Applicant and Mr. Pethe, learned APP for State.

Applicant stands convicted for offences punishable under the Foreigners Act, 1976 and Passport (Entry into India) Act. Applicant is arrested on 28.01.2025. She is having 1 & 1/2 year old child to whom she is required to provide care and support and who is with her in jail. 3.
Mr. Upadhyay would submit that Applicant had accompanied her father from Bangladesh when she was very young. Applicant refutes the prosecution case that she is not a citizen of India and states that she is a citizen of this country. Mr. Upadhyay would persuade the Court to consider the documentation which is appended to the Application in this regard in support of his submissions.

Considering the request made by Mr. Upadhyay that Applicant is a woman who is required to provide care and support for her child and her indictment in the offence under the aforesaid statutes, I am inclined to take up hearing of the present Application on the next adjourned date which shall be noted by the prosecution. 5.
Learned APP if desires to file affidavit in reply, the shall shall be be filed before the next adjourned date. Copy of the same shall be given in advance to Mr. Upadhyay.
