Heard Mr. Shaikh, learned Advocate for Applicant and Ms. Newton, learned APP for State.

At the outset, Mr. Shaikh informs the Court that there is typographical error crept in prayer clause (a) of the Application with respect to mentioning of correct CCTNS number. Hence he seeks leave to amend the same. Leave granted. Amendment is permitted to be carried out forthwith before this Court. Re-verification stands dispensed with.

3.Applicant stands indicted for the offence punishable under the NDPS Act for having been apprehended with the alleged contraband namely 62 grams of MD. He has been in incarceration since 07.03.2022 and as of today he has undergone a period of detention for 3 years & 19 days. Applicant has no antecedents. Mr. Shaikh would submit that

16. BA-1200-25.docx there is no hope that the trial would commence in the next foreseeable future and in that view of the matter, he requests the Court to consider the present Bail Application.

Learned APP shall take cognizance of the aforesaid submissions and apprise the Court on the next adjourned date about veracity of the same as also role of the Applicant.

Considering the long incarceration of the Applicant, present Bail Application shall be heard on the next adjourned date which shall be noted by the prosecution.
