Heard Mr. Katarnaware, learned Advocate for Applicant and Ms. Ganapathy, learned APP for Respondent.

Applicant is apprehended for offences under Sections 109, 115(2), 117(2), 118(1), 118(2), 189(2), 189(3), 189(4), 190, 191(2), 191(3), 351(2) and 352 of the Bharatiya Nyaya Sanhita, 2023; Sections 37(1) and 135 of the Maharashtra Police Act, 1951 and Sections 3 and and 25 of the Arms Act, 1959.

Mr. Katarnaware would persuade the Court to consider role of Applicant and his incarceration from 22.01.2025 for seeking regular bail. He would persuade the Court to consider one more aspect namely that Applicant is 52 years old and out of the 7 Accused persons, the other 6 co-accused persons have already been enlarged on bail by the Court. He would fairly submit to the Court that act of the

6.BA.1230.2025.doc Applicant was an act of self-defence which can be prima facie seen from the record of the case and therefore present Application needs consideration.

Another submission made by Mr. Katarnaware is that the present crime has occurred and emanated from a Societal perspective, inter alia, pertaining to forcible acquisition / grabbing of agricultural lands belonging to persons which has led to the present crime. 5.

Ms. Ganapathy, learned APP shall consider the aforesaid submissions made by Mr. Katarnaware and ascertain its veracity from the concerned Investigating Officer and apprise the role of Applicant on the basis of the prosecution case and statement recorded to enable the Court to consider the case for bail of the present Applicant. 6.
