The applicant is arrested in Crime No.789/2025 for the offence punishable under Sections 302, 307, 294, 143, 147, 148, 149, 354, 109 and 504 of the Indian Penal Code.

The applicant has filed this application on the ground of delay in trial. Since last three years the applicant is in jail and there is no progress in trial. Out of 6 accused, 5 are released on bail. Only this applicant is languished in jail. As the application is filed on the ground of delay in trial, the status report was called from the concerned Court.

After going through the status report it appears that accused persons who are released on bail are taking time and filing discharge application. As the discharge applications are pending the charge is not framed. Now the matter is fixed for hearing on discharge applications filed by accused Nos.5 and 6 and the matter is kept for hearing of A.P.P. on said discharge applications on 22.12.2025.

As since last three years there is no progress in trial and other co-accused are already released on bail, the applicant deserves to be released on bail. Hence I pass the following order:- i) Applicant - Syed Nazim Syed Salar be released on bail in Crime No.789/2025 for the offence punishable under Sections 302, 307, 294, 143, 147, 148, 149, 354, 109 and 504 of the Indian Penal Code, on furnishing P.R. Bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) with solvent surety in the like amount before the trial Court.

ii) The applicant shall not in any way tamper with the prosecution evidence.

iii) The applicant shall not pressurize or threaten the prosecution witnesses.

iv) The applicant shall co-operate with the learned trial Judge in the conduct of the trial.
