Heard Mr. Munde, learned Advocate for Applicant and Ms. Bajoria, learned APP for Respondent.

Applicant is arraigned as Accused No.2 out of 7 accused persons. 65.4 grams of the alleged contraband 'Mephedrone' has been recovered from the conscious possession of Applicant on being apprehended alongwith Accused Nos.1, 3 and 4 together. 3.
Case of prosecution is that on the disclosure made by apprehended accused persons, Accused No.5 being the supplier of alleged contraband was also arrested with 100 grams of contraband 'Mephedrone'.

Mr. Munde would persuade the Court to consider the long incarceration of Applicant since 19.10.2023 pending trial. He would
9.BA.1269.2025.doc submit that Accused No.5 has already been enlarged on bail by learned Trial Court despite he being found with commercial quantity of alleged contraband relying upon decision of this Court in the case of Chandrabhan Janardhan Yadav Vs. State of Maharashtra and connected matters1.

He would therefore persuade the Court to consider the case of Applicant on parity, as also on long incarceration and release Applicant on bail. He would submit that Applicant has no antecedents in cases under Narcotics and Psychotropic Substances Act, 1985 (for short 'NDPS Act') but there are certain other antecedents with respect to alleged crime.

Ms. Bajoria, learned APP enters appearance on behalf of prosecution. She shall take appropriate instructions from Investigating Officer on the submissions made by Mr. Munde and ascertain the veracity of the same and apprise the Court on the next adjourned date. 7.
Stand over to 16th April, 2025. To be placed on the 'Supplementary Board'.
