Heard the learned counsel appearing for the applicant and the learned APP for non-applicant /State. 2.
By this application, the applicant is seeking to grant bail in connection with Crime No.514/2024 registered with Police Station Kanhan, Nagpur for the offence punishable under Sections 309(4), 324(4), 324(5), 351(1), 351(2), 3(5) of the Bharatiya Nyaya Sanhita ("BNS") and under Sections 4/25 of the Arms Act. After investigation, vide charge-sheet Section 310(1) of the BNS was added.

The allegation in the FIR is that the applicant along with other co-accused persons armed with knife entered into the Bar and Restaurant of the informant and
2 24 BA 277.25 snatched amount of Rs.1000/- and also caused loss to articles amounting to Rs.15,276/-.

The learned counsel for the applicant submits that this Court granted bail to one of the accused from the present crime i.e. Shailesh S/o Kanhaiya Nagpure in Criminal Application No.735/2025 by an order dated 28.07.2025. The learned counsel for the applicant submits that no assault has been caused by the present applicant and therefore, considering the role played by the present applicant the application be allowed.

On the other hand, the learned APP opposes the present application on the ground that the applicant has played active role. The applicant was seen in the CCTV Footage, wherein he was holding the knife.

It appears from the order dated 28.07.2025 passed by this Court that allegations against Shailesh was of assault with knife and he was enlarged on bail. However so far as the present applicant is concerned, there are no allegations of assault with the help of knife. Considering the fact that Shailesh S/o Kanhaiya Nagpure has been granted bail by this Court. I am also inclined to grant bail
3 24 BA 277.25 to the present applicant for the same reasons and on the same terms and conditions passed in the Criminal Application No.735/2025 decided on 28.07.2025. 7.
Hence, the following order is passed:-
ORDER
(i) Criminal application is allowed and disposed of. (ii) The applicant/accused Abdul Rehman Shah S/o Abdul Rajjak Shah be released on bail in connection with crime No. 514/2024 registered with Police Station Kanhan, Nagpur for the offence punishable under Sections 309(4), 324(4), 324(5), 351(1), 351(2), 3(5) of the Bharatiya Nyaya Sanhita ("BNS") and under Sections 4/25 of the Arms Act (after investigation, vide charge-sheet Section 310(1) of the BNS was added) on his furnishing P.R. Bond of Rs. 25,000/- with one surety in the like amount. (iii) The applicant shall not indulge himself in similar types of the activities.
(iv) The applicant shall not induce, threat or promise any witnesses who are acquainted with the facts of the case either personally or by way of electronic mode. (v) The applicant shall attend the proceedings before the Trial Court without seeking any exemption unless there are exceptional circumstances.
(vi) A single registration of the offence would lead to the cancellation of bail.
